MCD – one rule for Streisand fans, another for the rest of us

In a couple of discussions at work recently, much has been made of the differing treatment from MCD given to Barbara Streisand ticket holders who had issues with the recent concert and that given to Oxegen concert goers after the 2006 concert.

Not just the actions of MCD – the National Consumer Agency, RTE, the national press and the Consumer Association of Ireland all kicked in to help the fans of Barbara Streisand, yet nothing done about Oxegen 2006 ticket buyers.

In the Barbara Streisand case, there’s 2 official investigations, hours of radio coverage and pages of newspaper print, and finally refunds and compensation to customers who had problems.

Yet, after apparent problems after the 2006 Oxegen concert, all that’s forthcoming from MCD are threats of legal action wherever the problems are discussed. I’m no fan of Indymedia, but this link shows those unfamiliar with that particular concert what is reputed to have happened.


Mixed Responses to “just and no more” MCD Compensation

I wondered here last week what MCD might come up with as a response to the report into the Barbara Streisand concert fiasco.

The responses that I’ve seen have been 50/50. Dermott Jewell of the Consumer Association of Ireland said it was a “poor deal” for consumers.

In what I think is a disgraceful “archers salute” type response to Mr. Jewell and consumers, the acting chief executive of the National Consumer Agency, Ms.Ann Fitzgerald disagreed, said it was a good deal and said “if people were unhappy they could take a case to the Small Claims Court”. This is a shocking response from the organisation that claims to be “Putting Consumers First”.

If consumers are unhappy, they should be able to go to the NCA, based on the way the portray themselves, not be fobbed off onto another agency instead.

Personally, I think this mention of the Small Claims Court is a complete red herring. Based on my reading of the situation, in this case, what MCD have offered consumers is pretty much the minimum they would have to had to pay had things gone to the SCC.


Barbra Streisand – the MCD report

The report into the fiasco that was the Barbara Streisand concert last July is due to be published any minute now – click here for the site where it will be available.

I have just tried to access it now, so hopefully whenever the site is fully launched, you won’t need the login and password that it’s asking for at the moment.

The Consumer Association of Ireland have said that MCD didn’t meet their contractual obligations for the many concert goers who didn’t get their allocated seat after paying €500 for it. On the basis of the relevant legislation, that means that the possible resolutions to this are as follows:

  • Repair
  • Replace
  • Refund

I wonder if any of these remedies are going to be proposed by this independent committee. Since they can’t fix things now, and there’s unlikely to be another Barbara concert, that just leaves refund. Chances???
